These Terms & Conditions ("Terms") govern your use of the CAPEZ FINANCE website, mobile application, and loan services (collectively, the "Platform"). By registering on the Platform, submitting a loan application, or availing any loan facility, you ("Borrower", "you") agree to be bound by these Terms.
1. Eligibility
- You must be at least 18 years of age and a resident Indian citizen with a valid mobile number, PAN, and Aadhaar (or other RBI-accepted KYC documents).
- Loan approval is subject to our internal credit assessment, KYC verification, and credit bureau checks. Meeting the eligibility criteria does not guarantee loan approval.
2. Loan Application & Disbursement
- All information provided by you during the application process must be true, accurate, and complete. Providing false information may lead to rejection or cancellation of your loan and appropriate legal action.
- Loan amount, tenure, interest rate, and EMI will be communicated to you in the Loan Agreement / Sanction Letter before disbursement, and disbursement will only proceed after you accept these terms.
- Loans are disbursed directly to your registered bank account.
3. Interest Rate & Charges
- Interest rate, processing fee, and any other applicable charges will be clearly disclosed in your Loan Agreement / Sanction Letter prior to disbursement, in compliance with RBI's Fair Practices Code.
- All charges (processing fee, late payment penalty, foreclosure charges, if any) are non-refundable once the corresponding service has been rendered, except as described in our Refund Policy.
4. Repayment
- You agree to repay the loan in the EMIs and on the due dates specified in your Loan Agreement, via the payment methods made available on the Platform (UPI, online payment, or cash collection through authorized staff).
- Payment receipts / confirmations issued through the Platform (SMS, app notification, or receipt) are proof of payment. Please retain your UTR/reference number or receipt until the payment reflects as "Paid" on your account.
5. Late Payment & Default
- A late payment penalty / fine, as disclosed in your Loan Agreement, will be charged on EMIs not paid by the due date.
- Continued non-payment may result in the loan being classified as delinquent, reporting to credit information companies (see Section 7), and recovery action in accordance with our Fair Practices Code — which prohibits any form of harassment, intimidation, or use of muscle power in the recovery process.
- Any field visit conducted for collection/recovery will be by an identified representative of CAPEZ FINANCE during reasonable hours, and will not involve any coercive or unfair practice.
6. KYC & Documentation
- You authorize CAPEZ FINANCE to collect, verify, and store your KYC documents (Aadhaar, PAN, photograph, business proof, etc.) for the purpose of loan processing, in accordance with RBI's KYC guidelines and our Privacy Policy.
7. Credit Bureau Reporting
- You authorize CAPEZ FINANCE to report your loan account details, repayment history, and any default to Credit Information Companies (such as CIBIL, Experian, Equifax, CRIF High Mark) as required under applicable law. This may affect your credit score.
8. Limitation of Liability
CAPEZ FINANCE shall not be liable for any indirect, incidental, or consequential loss arising from use of the Platform, except to the extent caused by our gross negligence or willful default.
9. Amendments
We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at [City, State].
